Jared Kushner, Trump's son-in-law, loses big in court to Jersey City

YUGE, GIANT, loss to Jersey City. Seems you can't swing a bankruptcied Trump property in New Jersey without hitting someone trying to claim something that's not theirs or trying to stiff someone just because its easier not to pay than live up to your obligations.

Jersey City in a state appeals court won $2.1 million dollars from Kushner's KABR Group who basically saw some money out there that was defaulted on by the previous owner of the current Bay St. Towers (dba Trump Towers) and started saying it was theirs. Terrence T. McDonald breaks it down better than Johnny:

The city had promised to repay the $2.1 million to Vector Urban Renewal, the original developer, but it kept the cash after Vector defaulted on its mortgage and walked away from the project, according to the Aug. 30 appellate court decision.

Morgan Street, which bought the property in a sheriff's sale in April 2011, argued in court that it inherited the $2.1 million credit the city owed Vector, but the appellate court on Monday ruled against the developers, saying they had no right to be reimbursed for money Vector paid the city.

The decision reverses a lower-court ruling in the developers' favor. A request for comment from Morgan Street's attorney was not immediately returned.

Basically since KABR had made changes to the original plan which means it's then not the same plan and KABR will get nothing and Jersey City rightly pockets $2.1 million. Hands off Johnny's taxpayer money Jared Kushner, that's a bad Jared Kushner!

Also today Jersey City resident Chuck U. Farley won the name the Bay St. Towers (dba Trump Towers) contest. The contest arose when Donald Trump rented out his name on the ugliest building he could find then his trusty Jared in law decided he wanted another ugly-ass building next to daddums' uninspired POS. Chuck named them "Butt" and "Ugly" which is spot on. So Butt and Ugly they are and so they shall be called. The original eyesore is Butt and the new hovel is Ugly, and truer words have never been spoken.

Late night open thread -- UPDATED

Johnny thinks you all know how he feels about Toll Brothers, their workers and their business practices. Yet, while taking the dire wolf out for a late evening walk (since surgery her schedule is a bit off) and noticed someone breaking into and taking things from the Toll Brother site at Warren and Morgan. Johnny did what you'd expect, he called 911 and waited. It was killing Johnny he had a 50% pup with him or he'd have confronted the thieves. He waited. Waited some more. Finally after a few more laps through the site and more stuff for the bed of his pickup the crook left with his partner and JCPD still never came. Christ, this city needs a first rate libarry (see below) and a first class police department to be the best mid-size city in America and both are holding us back right now. This is bigger than one 911 call friends, in Johnny's neighborhood this happens all too often. Cops strut like peacocks getting paid to stand around worksites (like the one ripped off toNIGHT) doing northing during the day but when you want them at night, the steroid abusers, the time sheet cheaters, and the drunk drivers have better things to do that truly make Jersey City the best it can be.

UPDATE 12:46 AM, wow, how bad is it when you update a Late Night thread? It happened a third time and friends, this was the worst. These clowns broke past the fencing and for 20 minutes were grabbing all they could with both hands and at times had so much they had to re-adjust the back of their pickup. Johnny called 911 again (third time not the charm) right when they pulled up and NOTHING. These guys were wandering around inside a locked site, they were easy pickings for the JCPD, IF they'd have cared the least bit to you know, catch someone in the act and arrest them and try and keep crime down. No other way to put it, the JCPD were nothing but lazy bastards tonight. Front to back, top to bottom something has to change but you know, police unions and so forth.

Long a sore spot in Jersey City, the main libarry set to reopen next week

Yes, libarry. If every great city has a library then Jersey City hasn't been a great city for a while as residents have waited forever and ever for the Jersey City Free Public Library's main branch on Newark Ave to reopen. Delayed again and again the date has finally been set for September 6th. Library Director Priscilla Gardner and Helena Ruman, the architect behind the renovations said this is a 115 year-old building and time is being taken to do things right:


But a lot of the construction involved goes toward restoring the historical details of the building.

Due to layers of renovations over the past century, much of the designs in the building have become "historically inappropriate," according to Ruman.

"This is one of the most historically significant buildings in the city," Ruman says, and she wants to demonstrate that through its restoration.

There will still be sections closed inside but a full reopening is scheduled for 2017.

Wow, this one has Johnny a little verklempt and not for the song itself. Johnny was looking for a song from the 70's that rang a bell and for laughs he was going to include a picture of an old style transistor hand held radio like many kids had back in the day. He searched Google and it really hit him when he saw a picture of the ACTUAL radio Johnny used for years as a poor kid who was all about the music and the idea of radio. An AM/FM 9Volt radio with an extra long antenna that allowed a kid just outside Detroit to listen in at night to Red Wings and Blues games from St. Louis on KMOX. Listening to the news in Richmond Virginia on WRVA. Wondering what the weather was in the coolest place on earth, New York New York and listen for the temperature in midtown, a place he can go on his roof deck and go look at with his own eyes. The memories in looking at this one image kept coming back; listening to the Grand Old Opry on WSM Nashville, or maybe WBBM in Chicago. Most of all though, it was about listening to music of all kinds and saving up for that next 9V battery. Kids these last couple decades have no idea how great they have it with iPods and at least 128 bit mp3's and AAC files and Spotify and what not and it's all pretty high quality. Back with these radios you had station drift and fuzzing in and out as you tried to learn the songs. Airplanes didn't help. Then CB radios came out and interfered with such AM giants like the Big 8, CKLW out of Windsor Ontario. CB almost ruined it all (that would ultimately happen with right wing talk radio) but back in the day you had this:

The E Streeters are back with Bruce tonight at the New Meadowlands where Jets and Giants roam for the last of his local shows (Philly does not count -- as always). Touring on The River album (but not playing it front to back) Bruce played a US record 3 hours 52 minutes Tuesday night and not that short of his all-time record of 4 and 6 in Finland in 2012.

Yeah, Johnny had tickets but someone had to watch the recovering dire wolf (no worries) and Mrs. Johnny has a colleague who jumped at the chance to go with her so Johnny's Springsteen punch on his Jersey card will have to wait. Drats.

Dateline Kearny: Two men were arrested for installing a skimming device, a small add-on to an ATM machine that allows thieves and lowlives to collect your account info AND PIN number.

Worthless human beings Alejandro Gonzalez-Scott, of Lyndhurst, and David Herrera-Rodas, of Newark were caught Aug. 10 at a QuikChek at Kearny and Bergen Avenues after someone alerted police who simply set up surveillance on the ATM and waited for the two idiots to show back up an arrest them. The both face multiple fraud charges.

Gotta be careful out there friends, check those ATMs before you put your card in, if it looks wrong, find another.

Interesting idea for the use of the Bergen Arches rail line

Bergen Arches, an old rail line that runs from "mostly parallel to Route 139, is a narrow passageway burrowed through a portion of the Palisades in the early 20th Century to bring Erie Lackawanna Railroad passengers to the Pavonia Avenue terminal."

The man behind the idea rightly sees this as an opportunity to hold onto green spaces that can be used and enjoyed by everyone, not just the well-heeled in big new downtown rental condos:

Gregory D. Edgell, of local production company Green Villain, said the idea of creating a Bergen Arches park has been percolating for nearly a decade. Transforming the abandoned track into usable open space would give balance to the real-estate development happening all over the city, Edgell said.

The plans really are quite cool in scope and vision. You'd do well for yourself to go check out an idea that remains just that....for now.

Any regulars know when a company gets a shout out on the Jersey City Desk they went above and beyond. It's true with the entire staff and doctors at Blue Pearl vet on 55th St in NYC. Johnny's dire wolf had a serious knee issue and they performed a serious surgery and got her back to Johnny and Mrs. Johnny in a day's time. Thanks to everyone at Blue Pearl, you helped put "pet parents" minds at ease with your care and follow-up calls through the evening and in the morning with pupdates.

Well Johnny is pleased as punch to share a song (soon to be more) of an album Johnny cut his teeth on in re-falling in love with Detroit bands (We feel you Royal Oak). Seeing them live in bars and in medium concert halls, oh gracious, what a band. Johnny knows all the words and can really do well on air guitar and drums on these songs as they've long since been committed to memory.

The administration should "take into account the new realities of Jersey City's growing development," Lavarro said last night, when the council adopted three new tax breaks, two 25-year abatements and one lasting 15 years.

Building in Jersey City is now "less of a risk in some neighborhoods," he said.

Now as many of you know Johnny has been after Council President Rolando Lavarro about being an absolute rubber stamp for Mayor Fulop's Crazy-Abatement-Land style of government. Now Lavarro is breaking with Fulop and we cautiously wonder if he doesn't finally see the light (That the Newport abatements are up and new tax rates as such are now allowing Mayor Fulop to hide a lot of his irresponsible spending) or if he's just talking the talk because he'd like to run for mayor next go-round if Fulop is successful in his yet unannounced bid for governor.

We're watching you Rolando, don't mess this up, spending is a serious serious issue. Glad you're listening.

Johnny just loves it when people outwit crooks by doing the simplest things

Long long ago when dinosaurs roamed the earth and Johnny was in college, like so many students putting themselves through school he had a part time job. It was at what in Michigan they call a party store, here a bodega. Think along the lines of a 7-11 or Mi-T-Mart from Fast Times at Ridgemont High. Johnny often worked the midnight shift when the more colorful customers would drop by.

One evening a fellow looking really no different than most went to the back cooler and grabbed a 12-pack of beer in each hand but not before lowering his ball cap. This piqued Johnny's curiosity. Long story short, yes, he acted like he was going to set the beer on the counter but turned and ran out as fast as he could. One gentleman entering the store noticed and yelled at the thief to stop and chased a few feet but for whatever reason thought better and came back to the store. He gave a statement to Ypsilanti PD but Johnny's statement was one of those simplest of things stopping stupid crooks. The police asked what kind of clues they could gather and Johnny simply said the guy's name is "XXXXX XXXXXXX" and he graduated from XXXX high school in 19XX;

The thief had worn his high school varsity jacket to steal the beer. Once he pulled his ball cap down Johnny made note of his last name. When he walked to the front he got his first name above his graduation year next to the varsity letter with his school's name on it. 20 minutes later the cops pulled up with the same guy in the back of their car and asked is he the one? Yes he is. Bye boy bye.

In Journal Square a robber entered the 7-11 there and demanded money. A harrowing moment perhaps. Unless the clerk simply stepped backwards two steps into an office and locked themselves inside.

The loser robber left empty-handed.

Nothing like spending more needless money eh Jersey City?

The state mandated and court ordered reval is going to cost Jersey City taxpayers another $5 million dollars as City Council, who haven't yet met something they wouldn't overspend on, will Wednesday approve asking for yet more money on the childishly delayed reval, no doubt because Mayor Fulop wants it.

It's mandated to be done in November of 2017, hey look an election date, and somehow the Fulop Administration who has no interest in it ever happening courts be damned. It has already fallen behind in the timeline. You have to love Fulop mouthpiece Jennifer Morrill who was sent out to pick the scab yet again that despite the courts consistently saying the first reval was done properly and it was Fulop acting childishly (in practically these same words) by making sure Mr. Petulant gets in some kind of imagined last word:

"We have always said this is a tight timeframe established by the state and we are working within that to comply, however, it is important that the best format and practices are followed, which was not the case previously," Morrill said.

Again, yes it was fair whether you think so or not. Anyway the judge decided you have no point there Jennifer and that's the only funny thing about this.

This here Jersey City, this is a hell of a price to pay for Steve Fulop's donor-class staying happy and that is ALL.THIS.IS.REALLY.ABOUT:

If the city's $4 million estimate holds, the cost to taxpayers for the reval will be at least $7.6 million. That includes the cost of the canceled reval ($3 million), legal fees Jersey City has been ordered to pay Realty Appraisal ($115,000 so far), costs for the firm Jersey City hired to defend itself in the case ($450,000 so far) and, to date, $26,954 in interest the city has been ordered to pay Realty Appraisal.

So we're begging $5 million for a job estimated to take 4, yet we're still loaning money to Bruce Rater to develop the Pep Boys site, the city spends money like a drunk teenager, the city doesn't raise taxes because we have such a surplus, so why not bond this out? Why take a high price loan with a quick turnaround payback if the city is only planning on doing revals every 20--30 years at gunpoint? What a poor use of city money.

It's like Donald Trump is somehow running 280 Grove St with his idiot minions with the kind of money decisions being made.

More ethical lapses come dripping out of the Fulop Adminsration

The constant drip drip drip of questionable ethical decisions by Mayor Fulop's Administration, which seemingly began even before he took office continued as some previously undisclosed information has come to the fore, Matt Friedman with Politico take it away:

In March 2012, when he was a Jersey City councilman, Fulop was quoted in a Bloomberg article saying that he was quitting his job in finance to run for mayor full-time. The election was scheduled for May, 2013. But some time after the article was published, he took a job with FAPS — a car import-related business that rents space from the Port Authority.

FAPS that year was in the midst of a lease dispute with the bi-state agency.

Emails released Wednesday showed how an aide to Gov. Chris Christie and his appointee at the Port Authority in 2012 used contract negotiations with FAPS to pressure Fulop, a Democrat, to endorse Christie for re-election in 2013.

Now, the Fulop spokesperson Jennifer Morrill says the Mayor or nobody in his administration can speak on this matter because they were advised to keep their yaps shut by the U.S. Attorney's office.

If you're a long-time reader of the Jersey City Desk, you know that whether Jennifer Morrill was saying Fulop sucked for the Healy Administration or that Healy sucked with the Fulop Administration her words have to be checked out thoroughly as facts often elude her. Well guess what, the U.S. Attorney's office said Morrill's comments were, you guessed it, NOT TRUE. You'll be doing yourself a favor by going over to read the full article and see just how badly the Mayor of Jersey City sounds in all this. Mr. Open Government, Mr. Honest Guy is sure not delivering on these counts.

Such bad news about Grove Street Bicycles

Johnny knew something bad was going on when he took the wolf out for a walk around 8am and saw smoke rising a few streets over. Johnny asked his dog if that weren't the laundromat that's next to the Grove Street Bicycles (and Johnny bought his bike there, who doesn't?). Sadly the fire was above the bike shop and pretty well gutted the building according to those standing around the site this afternoon. Here's hoping the bike shop can relocate somewhere nearby and soon. This is really awful when an honest local business that serves such a growing need goes on hiatus. Also hopefully someone with the city will reach out to help ensure Grove Street Bicycles can find the assistance available to them.

Jersey City is in a holding pattern waiting to see if Avon is moving here

The state's Economic Development Authority approved a tax incentive to New Avon LLC (Yes but very much the old Avon calling company) who are currently considering a site in Brooklyn to move to along with a spot at Exchange Place:

State officials are hoping New Avon LLC moves to a 113,625-square-foot office at 34 Exchange Pl. The state Economic Development Authority, which approved the tax break this morning, says the move would add 396 new full-time jobs.

The EDA says the state incentive, awarded as part of the Grow New Jersey Assistance Program, is necessary to make Jersey City a "more attractive location" for New Avon, which is also considering a 123,600-square-foot facility in Brooklyn. New York has offered "significant incentives" to lure New Avon to Brooklyn, according to the EDA.

Johnny likes THESE kind of incentives and abatements. State given, well thought out and the money is used to sweeten the pot at the correct time rather than making blank checks available. Smart move. Here's hoping New Avon becomes a new resident and partner with Jersey City. Love to have them!

It's just a though New Jersey...

But we'd do well to join Michigan AND now Oregon with the 10¢ bottle deposit bill. Oregon just joined Michigan and you'd be amazed, no really amazed how few cans and bottles litter the roadside or parking lots or anywhere else for that matter in the Spartan state. Sure Seinfeld made a funny episode about it but Johnny promises, it's well worth the cleansing the state will get.

Don't forget, this is the weekend the PATH says they're have mandated work to do

So the 33rd St. line will be closed from Friday at midnight til Monday at 5am for what PATH and the Port Authority says is federally mandated work to improve safety which is true. This work at a snails pace (Getting paid by the hour by the union?) will continue into December, maybe longer.

It was mandated EIGHT YEARS AGO. Take your time Port Authority and PATH. It's only our safety. Also, don't let prices and costs rise or anything before you get started. Your orders on this are as old as the Jersey City Desk. Congratulations.

Friday night MULTIMEDIA EXTRAVAGANZA with 'TIL TUESDAY!

First off, when the male protagonist at the very beginning tells Aimee Mann he's really happy the band is doing so well, Johnny doesn't think he's being sincere. That guy seems like a Trump supporter.

You can tell this video was made in the 80's because when Ms. Mann stands up and starts singing 'Voices' Carry' at Carnegie Hall from the audience, she's not flooded with cell phone light as show-goers break the no phone rule to catch her singingly defiant meltdown to post on YouTube.

Johnny is old enough to remember the night R.E.M. played this song, 'So. Central Rain' on the Ed Sullivan Show and it was #1 like the next day.

Sometimes you're just in the mood for a good song that's not trying to be too much or do too much, it just is and it sounds great. Johnny has always felt that way about this Dido track, 'Us 2 Little Gods' seen here on "Dido VEVO" which sounds the name of a soccer striker who might play for Espanyol in La Liga.

No word tonight on the fate of the guy who swam the Passaic River and vanished in the sewer. This is sounding like it has a bad ending. Life isn't like the movie The Fugitive.

Using Schroedinger's Cat as a reference was a lot cooler before The Big Bang Theory explained it to everyone.

Yes, at this hour Sewerman, read below, can be thought of as both alive and dead. Authorities are worried about sewer gasses and rising tides that could trap Sewerman, drowning him. In fact authorities are hoping he got out and away OK:

Ambrose said the rising tide of the Passaic River may have filled the pipes and that the man faced other dangers.

"There's gases, there's 8 feet of water in there," Ambrose said. "There's high tide. So I hope for his sake he did make it out."

What is it about human beings that they love a good chase?

Sure, we all understand in 99.9% of cases it's best if the police or authorities catch whomever it is they are chasing but if you give people a chase to watch, they'll tune right in. Dateline Newark; A man jumped from a car being chased by police in far western (and we mean far western) Harrison and jumped into the Passaic River and swam across and made his getaway via a storm drain. The Jersey Journal picks up the story (and wrote it):

From the bridge support, he swam to a storm drain and walked inside, police said. Specialized equipment was being deployed from the Passaic Valley Sewerage Commission to assist in the ongoing search shortly before 6 p.m.

Authorities did not immediately say why police stopped the man or release his name. Harrison police said more information would be available Thursday morning. 

So, if you're in Newark tonight and someone who smells like they've spent the better part of a day in a sewer and storm drain and they want to use the phone, just say no (after hitting them with the smell good) and call police. No word on if SewerMan is armed or dangerous.

Sometimes Johnny gets tired of just harping on Trump's many debacles, Christie's foibles, the mayor and council here spending like teenagers, and wants to show yes indeed there is a good side to life and it's going on right here around us.

Bike Hub, a new bicyckle shop in Jersey City in June on Monticello Ave., has launched what they call "The Bike Hub Children's Project."

What does that do? Great things friends:

With help from Manhattan-based Apollo Jets and price cuts from distributors, Behzad Pasdar will be receiving a shipment later this week of 41 bicycles he purchased that will be assembled and given to underprivileged kids in some of the city's toughest neighborhoods.

"We just have a different approach to interacting with the community," Pasdar said by phone yesterday afternoon.

Where is Chris Christie? Is he that lacking in honor he'd say anything? Has he gone that far down the Trump rathole he won't speak up hen a Gold-Star family is attacked by his candidate and his brain-dead minions? Today he called Hillary the Devil.

Where's the Governor of New Jersey because he's sure not standing up for our values right now.
